Measure Studio is a software product provided by Measure Studio, Inc. Measure Studio takes data privacy and security seriously. This privacy policy explains who we are, how we collect, share, and use Personal Information, and how you can exercise your privacy rights. We recommend that you read this privacy policy in full to ensure you are completely informed.

Note that by using our Services, you expressly consent to Measure Studio's collection, storage, and use of your information as described in this Privacy Policy. If you disagree with anything in this Privacy Policy, you may choose to not use the Services.

1. Basics

A. About Us

Measure Studio is a data and analytics software product (the "Services") operated by Measure Studio, Inc, a Delaware corporation headquartered in the State of Pennsylvania in the United States ("we," "us," "our," and "Measure Studio, Inc").

The Services enable our Users to collect, analyze, and share their own social media account data. The Services also allow Users to track and benchmark publicly available social media accounts they do not own, to analyze content and associated media and metadata using artificial intelligence (including our Archer AI assistant), to connect their authorized advertising accounts, and to connect third-party applications and AI agents to the Services through our application programming interfaces and Model Context Protocol ("MCP") server. B. Key Terms

In this privacy policy, these terms have the following meanings:

"User" means any person or entity that is registered with us to use the Services. Most commonly, Users are typically social media creators, digital media publishers, brands, or agencies managing social media accounts.

"Personal Information" means any information that identifies or can be used to identify a User, directly or indirectly. Examples of Personal Information include, but are not limited to, full name, email address, phone number, address, payment or banking details, and software usage data.

"Social Media Data" means any information collected that is privately made available to us via the express authorization of Users for each social media account they connect to the Services. Examples of Social Media Data include, but are not limited to, published content, content metadata such as titles or descriptions, engagement data such as impressions, video views, and comments, social audience demographics, and geography. Social media platforms supported at the time of this writing include YouTube, Facebook, Instagram, X, Snapchat, TikTok, LinkedIn, and may include more platforms in the future.

"Advertising Data" means data from advertising accounts that a User connects and authorizes, such as campaign, spend, delivery, and performance metrics and associated audience metrics.

"Public Account Data" means information about social media accounts, content, and activity that a User elects to track but does not own or operate, such as competitors and other public accounts. Public Account Data strictly includes public media and publicly visible performance metrics.

"Customer Content" means media, posts, and associated metadata (such as transcripts, titles, captions, and descriptions) that a User submits to or connects with the Services for analysis.

"Subprocessor" means a third party we engage to process personal information on our behalf in order to provide the Services.

Controller and processor roles. For Personal Information about Users that we collect to provide and operate the Services (such as registration, billing, device, and usage information), Measure Studio, Inc is the controller. Where we process Social Media Data, Advertising Data, or Customer Content on a User's behalf and under the User's instructions, we act as a processor for that User.

"Website(s)" means any website(s) we own and operate (such as www.measure.studio, www.measurestudio.co, www.measurestudio.io) or any web pages, interactive features, applications, widgets, blogs, social networks, social network "tabs," or other online, mobile, or wireless offerings that post a link to this privacy policy.

"You" and "your" refers to the User.

2. Privacy for Users

This section applies to the Personal Information we collect and process from a User or Potential User through the provision of the Services. In this section, "you" and "your" refer to Users and Potential Users.

A. Information We Collect

The Personal Information that we may collect broadly falls into the following categories:

(i) Information you provide to us: In the course of engaging with our Services, you may provide Personal Information about yourself, other Users you invite to your account, or your social media accounts. Personal Information is often, but not exclusively, provided to us when you sign up for and use the Services, consult with our User support team, send us an email, integrate the Services with another website or service (for example, when you choose to connect your Instagram account(s) with Measure Studio), or communicate with us in any other way.

We will let you know prior to collection whether the provision of Personal Information we are collecting is compulsory or if it may be provided on a voluntary basis, as well as the consequences, if any, of not providing such information. By giving us this information, you agree to this information being collected, used, and disclosed as described in our Terms of Use and in this privacy policy.

This information may include:

Registration information: You need a Measure Studio account to use the Services as a User. When you register for an account, you will be asked to provide certain basic information, such as your name, email address, password, and phone number (for example, if you are using two-factor authentication).

Billing and communications information: If you purchase our Services, you may also need to provide us with payment and billing information, such as your bank information, credit card details, and billing address. We will also maintain a record of your billing transactions and purchases, and any communications and responses.

Information we process on your behalf: In order to provide you with data and analytics features in your account, you need to authorize us to collect data from your social media accounts.

(ii) Information we collect automatically: When you use the Services, we may automatically collect certain information about your device and usage of the Services. We use cookies and other tracking technologies to collect some of this information. Our use of cookies and other tracking technologies is discussed more below.

This information may include:

Device information: We collect information about the device and applications you use to access the Services, such as your IP address, your operating system, your browser ID, and other information about your system and connection.

Log data: Our web servers keep log files that record data each time a device accesses those servers and those log files contain data about the nature of each access, including originating IP addresses. We may also access metadata and other information associated with files that you upload into our Services.

Product usage data: We collect usage data about you whenever you interact with our Services, which may include the dates and times you access the Services and your browsing activities (such as what portions of the Services are used). We also collect information regarding the performance of the Services, including metrics related to the deliverability of emails alerts. This information allows us to improve the content and operation of the Services, and facilitate research and analysis of the Services.

(iii) Information we collect from social media platforms: We actively acquire information about your social media content from social media platforms. We are only able to collect such data with your explicit authorization for each social media account. You are able to revoke our authorization to collect this data at any time in Measure Studio or in your social media account settings.

We also collect Advertising Data from advertising accounts you connect and authorize (for example, Meta Ads, Google Ads, and TikTok Ads), including campaign, spend, delivery, and performance metrics and associated audience metrics, in order to provide paid and organic performance analytics.

By using Measure Studio to track and analyze your YouTube channel data, you agree to be bound by YouTube's terms of service.

Examples of the information we receive from social media platforms include audience demographic information (such as age and gender), social media content metadata such as post text and video titles, and online behavioral data (such as impressions, video views, and social engagements on social media content). We use this information, alone or in combination with other information we collect, to enhance our ability to develop and provide you with more relevant products, features, and services.

(iv) Information we collect about non-Users and tracked accounts: When you use the Services to track public accounts or benchmark accounts you do not own, and when you submit or connect Customer Content, we may collect and process personal information about individuals who are not Users. This may include public account owners, public figures identified in or associated with content, and individuals who appear in, are referenced in, or engage with content. We process this information to provide benchmarking, competitive analysis, and content-analysis features. Where this information relates to individuals in the EEA or UK, we rely on our legitimate interests (and those of our Users) in providing these analytics features, balanced against the interests and rights of those individuals. Because we do not collect this information directly from those individuals, certain transparency obligations may apply; individuals may contact us at support@measure.studio to exercise applicable rights, including objection and deletion.

Artificial Intelligence Features

We use artificial intelligence, including third-party large language models, to analyze Customer Content and the content and metadata associated with social media posts — such as transcripts, titles, captions, and descriptions — and to generate insights, which may include identifying public figures referenced in or associated with the content, classifying content, and producing summaries and recommendations. Our Archer AI assistant also responds to your prompts using your data.

We do not use facial recognition technology, we do not create, collect, or store faceprints, voiceprints, or other biometric identifiers, and we do not perform facial emotion analysis. Public-figure and other identifications are generated by automated systems based on content and metadata rather than biometric matching, and may be inaccurate.

To provide these features, we transmit Customer Content and related content and metadata to third-party artificial intelligence providers that act as our Subprocessors, currently Google LLC and OpenAI, L.L.C. We do not sell your Customer Content, we do not use your Customer Content to train publicly available foundation models, and we engage these providers under business or enterprise terms that do not permit them to train their models on the data we submit. See "Subprocessors" in Section 3.

B. Use of Personal Information

We may use the Personal Information we collect through the Services or other sources for a range of reasons, including:

To send you alerts about your social media content performance.
To send you updates on your subscription, including plan changes and cancellations.
To send you updates on changes to your account, including when social media accounts or users are added and removed from your account.
To bill and collect money owed to us by you. This includes sending you emails, invoices, receipts, notices of delinquency, and alerting you if we need a different credit card number. We use third parties for secure credit card transaction processing, and those third parties collect billing information to process your orders and credit card payments.
To send you system alert messages. For example, we may inform you about temporary or permanent changes to our Services, such as planned outages, or send you account, security or compliance notifications, such as new features, version updates, releases, abuse warnings, and changes to this privacy policy.
To communicate with you about your account and provide User support.
To enforce compliance with our Terms of Use and applicable law, and to protect the rights and safety of Users, and third parties, as well as our own. This may include developing tools and algorithms that help us prevent violations.
To meet legal requirements, including complying with court orders, valid discovery requests, valid subpoenas, and other appropriate legal mechanisms.
To provide information to representatives and advisors, including attorneys and accountants, to help us comply with legal, accounting, or security requirements.
To prosecute and defend a court, arbitration, or similar legal proceeding.
To respond to lawful requests by public authorities, including to meet national security or law enforcement requirements.
To provide, support and improve the Services. For example, this may share your information with third parties in order to provide and support our Services or to make certain features of the Services available to you.
To inform published social media data studies. In the case that we publish any social media data, it will be anonymized or aggregated with data from other accounts, and will not be identifiable as your data in any way.
Other purposes. To carry out other legitimate business purposes, as well as other lawful purposes about which we will notify you.

C. Cookies and Tracking Technologies

We and our partners may use various technologies to collect and store information when you use our Services, and this may include using cookies and similar tracking technologies, such as pixels. For example, we use Google Analytics to assess which Services you use and how you use them. We use this information to provide analytics information and enhance the effectiveness of our Services. Reports are also available to us when we send email or support chat messages to you, so we may collect and review that information.

When you visit our website, we and our advertising partners use cookies and similar technologies, including the Meta Pixel, LinkedIn Insight Tag, RB2B, Poptin, and G2 attribution tracking, to measure our marketing, identify business visitors, support lead capture and attribution, and deliver advertising to you on other sites and platforms. These technologies may disclose identifiers and information about your activity on our site to those providers. This constitutes "sharing" for cross-context behavioral advertising (and may constitute a "sale" or "targeted advertising") under U.S. state privacy laws. You can opt out as described in "California Privacy Rights (CCPA/CPRA)" and "Other U.S. State Privacy Rights" below, including via the "Do Not Sell or Share My Personal Information" link in our website footer, and we honor Global Privacy Control (GPC) browser signals.

D. Secure Data Storage, Non-Resale, Data Portability

Your Personal Information and Social Media Data is stored on a secure server. We do not, under any circumstances, sell your Personal Information or Social Media Data for money. We may, however, "share" limited identifiers and online activity for cross-context behavioral advertising through advertising cookies and pixels as described in "Cookies and Tracking Technologies" above and "California Privacy Rights (CCPA/CPRA)" below; you can opt out of that sharing as described there. You may export (download) your Social Media Data from Measure Studio at any time.

E. Non-Usage in Other Software

While Measure Studio is owned and operated by Measure Studio, Inc, we will not use your data collected in Measure Studio for use in other software products we may develop now or in the future.

F. Other Data Protection Rights

You may have the following data protection rights:

To access, correct, update or request deletion of Personal Information. We take reasonable steps to ensure that the data we collect is reliable for its intended use, accurate, complete, and up to date. As a User, you can manage your individual account and profile settings within Measure Studio, or you may contact us directly by emailing us at support@measure.studio. If you choose to terminate your subscription, we will delete your user and data following the completion of your subscription term.

You can revoke Measure Studio's access to your authorized data without logging in to Measure Studio, by navigating to each platform's security settings, found using the links below. Note that revoking such authorizations will eliminate most functionality in Measure Studio, including our ability to track new post or accounts data.

You may also remove accounts from Measure Studio at any time. When you remove accounts, we automatically delete your data from our systems, and this action cannot be undone.

You may delete your Measure Studio account at any time. When you delete the Measure Studio account, all data we've collected on your behalf from any connected social media accounts will be automatically deleted from our systems, and this action cannot be undone. To delete your Measure Studio account, click Settings > Subscription or contact support@measure.studio for assistance.

In addition, individuals who are residents of the European Economic Area (EEA) can object to the processing of their Personal Information, ask to restrict processing of their Personal Information, or request portability of their Personal Information. You can exercise these rights by contacting us using the contact details provided in the "Questions and Concerns" section below.
Similarly, if Personal Information is collected or processed on the basis of consent, the data subject can withdraw his or her consent at any time. Withdrawing consent will not affect the lawfulness of any processing we conducted prior to withdrawal, nor will it affect processing of Personal Information conducted in reliance on lawful processing grounds other than consent.
The right to complain to a data protection authority about the collection and use of Personal Information. For more information, please contact your local data protection authority.

We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection law. We may ask you to verify your identity in order to help us respond efficiently to your request.

G. Google Policy Adherence

Measure Studio's use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

3. General Information

We may share and disclose your Personal Information to the following types of third parties for the purposes described in this privacy policy (for purposes of this section, "you" and "your" refer to Users unless otherwise indicated):

(i) Our service providers: Sometimes, we share your information with our third-party service providers, who help us provide and support our Services and other business-related functions — for example, to analyze data, to host data, engaging technical support for our Services, processing payments, and delivering content. These third-party service providers enter into a contract that requires them to use your Personal Information only for the provision of services to us and in a manner that is consistent with this privacy policy.

(ii) Any competent law enforcement body, regulatory body, government agency, court or other third party where we believe disclosure is necessary (a) as a matter of applicable law or regulation, (b) to exercise, establish, or defend our legal rights, or (c) to protect your vital interests or those of any other person.

(iii) A potential buyer (and its agents and advisors) in the case of a sale, merger, consolidation, liquidation, reorganization, or acquisition. In that event, any acquirer will be subject to our obligations under this privacy policy, including your rights to access and choice.

(iv) A company providing you with a free Measure Studio license. We provide a Bulk License subscription, through which a single user or company can buy multiple Measure Studio licenses and provide a dedicated Measure Studio account free of charge to others. If you use a Measure Studio account provided to you by another user or company via a bulk license, that user or company will have access to and can download any social media data and personal information that you have provided to Measure Studio.

(v) Any other person with your consent.

Subprocessors

We engage Subprocessors to help provide the Services. We require each Subprocessor by contract to use personal information only to provide services to us and in a manner consistent with this privacy policy and applicable law. The categories of Subprocessors we currently use include:

Artificial intelligence providers: Google, OpenAI for content analysis.
Cloud hosting and infrastructure: Amazon Web Services (AWS).
Payment processing: Chargebee.
Product analytics: PostHog.
Customer support and messaging: Fin (formerly Intercom).
Email and communications: HubSpot.

We may update this list of Subprocessors from time to time.

Third-Party Applications and AI Agents You Connect

The Services allow you to connect third-party applications, services, and AI agents (including third-party AI assistants) to your account through our APIs and MCP server. When you connect such a client, the data you authorize it to access is transmitted to that client and its providers, and is then governed by the privacy policies and terms of that client and its providers, not by this privacy policy. We are not responsible for the data practices of third-party clients or their providers.

B. Legal Basis for Processing Personal Information (EEA and UK Persons)

If you are from the European Economic Area (EEA) or the United Kingdom (UK), our legal basis for collecting and using the Personal Information described above will depend on the Personal Information concerned and the specific context in which we collect it.

However, we will normally collect and use Personal Information from you where the processing is in our legitimate interests and not overridden by your data-protection interests or fundamental rights and freedoms. Typically, our legitimate interests include improving, maintaining, providing, and enhancing our technology and products; ensuring the security of the Services and our Websites; and for our marketing activities. If you are a User, we may need the Personal Information to perform a contract with you. In some limited cases, we may also have a legal obligation to collect Personal Information from you. Where required by law, we will collect Personal Information only where we have your consent to do so.

We also rely on our legitimate interests (and those of our Users) to provide competitive benchmarking, Public Account Data, and AI content-analysis features, where those interests are not overridden by the rights of the individuals concerned. Where we process special categories of data, or where consent is otherwise required, we rely on consent. References in this privacy policy to the GDPR include the UK GDPR as applicable to United Kingdom individuals.

International Data Transfers

We are based in the United States and may process and store personal information in the United States and other countries. Where we transfer personal information from the EEA, the UK, or Switzerland to a country that has not received an adequacy decision, we rely on appropriate safeguards, such as the European Commission's Standard Contractual Clauses and the UK International Data Transfer Addendum. You may request a copy of the safeguards we use by contacting us.

Data Retention

We retain personal information for as long as necessary to provide the Services and for the duration of your subscription, and thereafter as needed to comply with our legal obligations, resolve disputes, and enforce our agreements. When personal information is no longer needed, we delete or de-identify it. Social Media Data, Advertising Data, and Customer Content associated with a connected account are deleted or de-identified when you disconnect the account or terminate your subscription, except for data that has been aggregated and de-identified or that we are required to retain by law.

C. Your Choices and Opt-Outs

Users who have opted in to our marketing emails can opt out of receiving marketing emails from us at any time by clicking the "unsubscribe" link at the bottom of our marketing messages. Also, all opt-out requests can be made by emailing us using the contact details provided in the "Questions and Concerns" section below. Please note that some communications (such as service messages, account notifications, billing information) are considered transactional and necessary for account management, so Users cannot opt out of these messages during the term of their Services per their software license agreement with Us.

You acknowledge that by using Measure Studio, you grant us permission to use your or your company's social media account's name, logo, or any other marks on our website and in our marketing materials. You can opt out of being included on our website or in our marketing materials any time by contacting support@measure.studio.

D. Our Security

We take appropriate and reasonable technical and organizational measures to protect Personal Information from loss, misuse, unauthorized access, disclosure, alteration, and destruction, taking into account the risks involved in the processing and the nature of the Personal Information. If you have any questions about the security of your Personal Information, you may contact us at support@measure.studio.

Measure Studio accounts require a username and password to log in, and may require a phone number for two-factor authentication as an added layer of account access security. Users must keep their username and password secure and never disclose these to a third party.

E. California Privacy

California Privacy Rights (CCPA/CPRA). If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA"), provides you with the rights described below. In the preceding 12 months, we have collected the following categories of personal information: identifiers (such as name, email, phone number, and IP address); commercial information (such as subscription and billing records); internet or other electronic network activity (such as usage and device data); professional or employment-related information; geolocation data; and inferences drawn from the above. We collect this information from you, from your device, from your connected accounts and social platforms, and from public sources. We use it for the purposes described in "Use of Personal Information" above, and we disclose it to the categories of recipients described in "How We Share Information" and "Subprocessors."

Sensitive personal information. We do not use facial recognition or collect biometric identifiers. To the extent we process any sensitive personal information (such as account log-in credentials), we use it only to provide the Services and for purposes permitted by the CCPA, and not to infer characteristics about you.

Sale and sharing. We do not sell your personal information for money. We do "share" certain identifiers and internet activity for cross-context behavioral advertising through the advertising cookies and pixels described in "Cookies and Tracking Technologies." You have the right to opt out of this sharing at any time via the "Do Not Sell or Share My Personal Information" link in our website footer, by broadcasting a Global Privacy Control (GPC) signal, or by contacting us at support@measure.studio.

Your CCPA rights. You have the right to know and access the personal information we have collected; to delete it; to correct inaccurate information; to opt out of the sale or sharing of personal information; to limit the use of sensitive personal information; and not to receive discriminatory treatment for exercising your rights. You may submit a request by emailing support@measure.studio. You may use an authorized agent to submit a request on your behalf. We will verify your identity before fulfilling your request, consistent with the CCPA.

California "Shine the Light." In addition:

Under California Law, California residents have the right to request in writing from businesses with whom they have an established business relationship, (a) a list of the categories of Personal Information, such as name, email, and mailing address, and the type of services provided to the User that a business has disclosed to third parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for the third-parties' direct marketing purposes, and (b) the names and addresses of all such third parties. To request the above information, please contact us through our contact form or email us at support@measure.studio.

Other U.S. State Privacy Rights

If you are a resident of Virginia, Colorado, Connecticut, Texas, Utah, Oregon, Montana, or another U.S. state with a comprehensive consumer privacy law, you may have the right to confirm whether we process your personal information and to access it; to correct inaccuracies; to delete it; to obtain a portable copy; and to opt out of the sale of personal information, targeted advertising, and certain profiling. Where required, we will obtain your consent before processing sensitive data. To exercise these rights, contact us at support@measure.studio. We honor recognized universal opt-out mechanisms where required by law. If we deny your request, you may appeal by contacting us at support@measure.studio; if your appeal is denied, you may contact your state attorney general.

F. Children under 13 years of age

The Services are not intended for children under age 13 or for anyone under age 18 without the involvement of a parent or guardian. We do not knowingly collect or distribute information from or about children under 13.

G. Changes to this Policy

We may change this privacy policy at any time and from time to time. The most recent version of the privacy policy is reflected by the version date located at the top of this privacy policy. All updates and amendments are effective immediately upon notice, which we may give by any means, including, but not limited to, by posting a revised version of this privacy policy or other notice on our Websites. For material changes, we will provide reasonable advance notice by email or through the Services before the changes take effect. We encourage you to review this privacy policy often to stay informed of changes that may affect you.
